1. Agreement

By downloading or using Tiny Dreamer Sounds (“the app”) you agree to these Terms and to the Apple Standard End User License Agreement (EULA). If they conflict, the Apple EULA prevails on matters it covers. The app is provided by Thuyen Nguyen, an individual based in Vietnam (“we”). If you do not agree, do not use the app.

2. The app

The app plays white noise, lullabies, nature sounds and similar audio with a sleep timer, a night mode and related tools. Most features work offline and without an account. You must be old enough to enter a binding contract in your country to buy Premium.

3. Not medical advice; safe use

• The app is not a medical device. It does not diagnose, treat or promise any result for sleep or health, and it is no substitute for advice from a doctor.
• Keep the volume low, keep the phone at least 2 m (6.5 ft) from the crib, and do not place it in the crib. You stay responsible for your child’s safety and for supervising them.
• The default volume limit is there to protect hearing. If you remove it, you do so at your own responsibility.

4. Premium subscription

Premium is optional. Prices in USD; in other countries the price is Apple’s equivalent, shown in the purchase sheet.

• Yearly: $29.99 per year, with a 7-day free trial for eligible new subscribers (one trial per Apple ID subscription group).
• Weekly: $4.99 per week, no free trial.
• Payment is charged to your Apple ID at purchase confirmation, or at the end of the free trial. Any unused part of a free trial is forfeited when you buy a subscription.
• Subscriptions renew automatically at the same price for the same period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• Manage or cancel in iPhone Settings → your name → Subscriptions. Deleting the app does not cancel. Cancelling stops the next renewal; Premium stays active until the paid period ends.
• Refunds are handled by Apple under its policies (reportaproblem.apple.com).
• The yearly plan supports Apple Family Sharing for members of your Family group. “Restore purchases” in Settings recovers Premium on your devices with the same Apple ID.
• We may change prices or plans in the future; changes apply only after Apple’s notice and your consent where required.

5. License and acceptable use

We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control. You may not copy, modify, reverse engineer or resell the app or its audio, remove its protections, or use it unlawfully.

6. Ownership

The app, its sounds, lullabies, texts and design belong to us or our licensors and are protected by copyright. Your own voice recordings and entered data remain yours.

7. Third-party services

Payments are provided by Apple, subscriptions by Adapty, analytics and crash reports by Google Firebase. Their terms apply to their services. See our Privacy Policy.

8. Disclaimer

The app is provided “as is” and “as available”. To the extent the law allows, we make no warranty that it will be uninterrupted or error-free, or that audio will keep playing in all conditions (for example if iOS ends background audio, or the battery runs out).

9. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential damages, or for loss of data, and our total liability for any claim is limited to the amount you paid for the app in the 12 months before the claim. Nothing limits liability that cannot be limited by law, including consumer rights where you live.

10. Termination

You can stop using the app at any time. We may suspend access if you seriously breach these Terms. Subscriptions are ended through Apple as described above.

11. Changes

We may update these Terms; the new date is shown at the top and, for material changes, in the app. If you keep using the app, you accept the update. The English version prevails if a translation differs.

12. Governing law

These Terms are governed by the laws of Vietnam, without affecting mandatory consumer protection rules of the country where you live.
